Terms and conditions

Applies to orders placed from 25 September 2026 where these terms were provided before purchase.

1. Seller and scope

The seller is KOMA Marek Kołodziejczyk, Sidzina 670, 34-236 Sidzina, Poland; VAT number PL5521612085. Contact: info@koma-shop.eu, telephone +49 3581 7925486.

These terms apply to purchases from koma-shop.eu / moebel-koma.de, not to contracts concluded on eBay. We sell the furniture described in our product listings. A consumer is an individual acting for purposes outside their trade or profession, as defined by applicable law. Statutory consumer protections extended to certain self-employed buyers remain unaffected.

2. Ordering and the contract

Select the product, available size, colour and quantity, add it to the basket, enter the information required for fulfilment and choose delivery and payment. Before submitting the order, you can check and correct your details and review the total price and terms. A customer account is not required to exercise statutory consumer rights.

The contract is concluded when your order is successfully submitted using the button clearly indicating an obligation to pay. We send the order confirmation, agreed conditions, these terms and withdrawal information to your email address in a form you can retain. The confirmation does not unilaterally change your order.

Contracts may be concluded in Polish, German, English or Dutch according to the selected shop language. You may save or print these terms. The version provided when you place your order applies to that order. Later changes do not alter existing contracts.

3. Prices and payment

Prices include applicable taxes. The currency, total price, delivery charges and any supplements are displayed before you place the order. Standard delivery to Poland and Germany is free. If cash on delivery in Poland is offered at checkout, the surcharge is PLN 19 per order and is included in the order total.

Available payment methods and their conditions are shown at checkout. For advance payment, processing starts once payment is received; for cash on delivery, it starts upon receipt of the order. We do not add charges to which you have not agreed before purchasing.

4. Delivery and furniture characteristics

We deliver to Poland and Germany and to other countries for which a delivery option is offered during ordering. Availability, charges and delivery time for the address provided are stated before purchase. A language version alone does not mean delivery is offered to a particular country.

Standard delivery takes 7 working days: 4 for preparation and 3 for transport, from the start of processing described in section 3. Working days are Monday to Friday, excluding public holidays. Any different period for an individual product must be clearly stated before purchase.

The selected product description specifies dimensions, finish, included parts and any self-assembly requirements. Natural wood grain and colour may vary between items; this does not exclude liability for non-conformity or for departures from agreed characteristics.

We bear the risk of accidental loss or damage in transit until you, or a person you nominate other than the carrier, receive the goods, subject to the statutory exception where you independently commission a carrier we did not offer. Please report visible transport damage and, where possible, ask for a damage report. Failure to obtain a report does not remove your statutory remedies.

5. Faulty goods and complaints

The seller is responsible for conformity with the contract under applicable law. Complaints may be sent to info@koma-shop.eu or by post to the seller's address. Please describe the problem, identify the purchase and state your requested remedy to help us deal with it. Photographs may help, but are not an additional unlawful condition of a claim; a till receipt is not the only acceptable proof of purchase.

You may request repair or replacement and, where the legal conditions are met, a price reduction or termination of the contract. Necessary costs of a justified remedy, including transport and legally required removal and reinstallation costs, are borne by the seller. The 14-day withdrawal period does not limit these rights.

Where Polish consumer law applies, the seller is liable for non-conformity becoming apparent within two years of delivery, subject to statutory exceptions and longer rights, and responds to consumer complaints within 14 days on paper or another durable medium. Other mandatory national rights and time limits remain unaffected. In particular, where Dutch conformity rules apply, rights are not automatically limited to two years: the product's reasonably expected life and other relevant circumstances matter. An additional commercial warranty does not replace the seller's statutory liability.

6. Right of withdrawal

Consumers may withdraw from the contract without giving a reason within 14 days. The period starts when you, or a person you nominate other than the carrier, take possession of the goods. For a single order delivered separately, it starts on receipt of the last item; for goods delivered in parts, on receipt of the last part.

To withdraw, send a clear statement of your decision to KOMA Marek Kołodziejczyk, Sidzina 670, 34-236 Sidzina, Poland; email info@koma-shop.eu. You may use the form below, but do not have to. Sending your statement before the deadline is sufficient. Prior approval from the seller is not required.

We will reimburse payments received, including the cost of the least expensive standard delivery we offered, without undue delay and no later than 14 days after receiving your withdrawal notice. Additional costs arising from a more expensive delivery option you selected are not refundable. We use the original payment method unless you expressly agree to another method that does not involve charges for you.

Unless we have offered to collect the goods, we may withhold reimbursement until we receive the goods or evidence that you sent them back, whichever occurs first. Under our additional shop policy, reimbursement is made within 2 days of receipt of the return, without delaying any earlier refund required by law.

Return or hand over the goods without undue delay and within 14 days of notifying us, unless we have offered to collect them. Dispatch before that deadline is sufficient. The returns address is KOMA Marek Kołodziejczyk, Sidzina 670, 34-236 Sidzina, Poland.

For withdrawal from a purchase of goods that match the order, for example because the buyer selected the wrong colour or size or changed their mind, the buyer bears the direct return shipping costs. This also applies to returning goods for an agreed exchange for these reasons. Giving a reason for withdrawal is not required.

Return transport arranged by KOMA costs PLN 19 per parcel sent from Poland and EUR 19 per parcel sent from any other country served by the shop. The total is the number of parcels multiplied by the applicable rate. We confirm the parcel count and total before booking the transport. You may also return the goods using your own carrier at your expense; in that case we do not add a KOMA transport charge. There is no additional restocking or return handling fee.

These charges do not apply to a justified complaint concerning a defect, transport damage, delivery of the wrong product or other non-conformity for which the seller is responsible. KOMA arranges and pays for the necessary transport in such cases.

To arrange transport, email info@koma-shop.eu. Prior approval from the seller and original packaging are not conditions of a valid withdrawal. Please protect the furniture adequately and include accessories. The new cost rules apply to orders placed after this information was provided before purchase; any free-return entitlement promised under an earlier contract remains valid.

You are liable only for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, in accordance with applicable law. These terms do not impose a blanket exclusion of withdrawal for furniture manufactured after ordering or for standard catalogue options.

7. Use of the shop and personal data

Purchasing requires internet access, a current browser and an email address. You must provide accurate details needed to fulfil the order and must not submit unlawful content. A customer account, if created, is free; you may request its closure at our contact address. Closure does not affect outstanding orders or statutory claims. 8. Applicable law and disputes

Applicable law and court jurisdiction are determined by the relevant legal rules. These terms do not remove mandatory consumer protection in your country of habitual residence. No language version takes precedence in a way that restricts those rights.

You may seek help from national consumer bodies and the European Consumer Centre and, where appropriate, use alternative dispute resolution. Your right to go to court remains unaffected.
